1. Introduction and Acceptance

By engaging our services, you (“Client,” “you,” or “your”) agree to be bound by these Terms.

2. Company Authorization and Registration

Mohammed Moinuddin Real Estate Services operates as a fully licensed and registered real estate broker in accordance with the laws and regulations of the United Arab Emirates. We maintain authorized partnerships and sales agreements with property developers across the UAE, enabling us to offer comprehensive property solutions to our clients.

Our operations are conducted in full compliance with:

  • UAE Federal Law No. 26 of 2007 on Real Estate Regulatory Agency (RERA)
  • Dubai Land Department regulations
  • Real Estate Regulatory Agency guidelines
  • All applicable UAE federal and emirate-level legislation

3. Services Provided

4. Client Obligations and Responsibilities

4.1 Information Accuracy

Clients must provide accurate, complete, and truthful information regarding:

  • Financial capacity and funding sources
  • Identity documentation and legal status
  • Investment objectives and requirements
  • Any material changes to circumstances during the transaction process

4.2 Due Diligence

Clients are responsible for conducting their own due diligence regarding:

  • Property inspections and valuations
  • Legal title verification
  • Financial and investment suitability
  • Compliance with applicable laws and regulations

4.3 Financial Obligations

Clients must ensure adequate funding is available for all agreed transactions and understand all associated costs, including but not limited to purchase price, registration fees, and applicable taxes.

5. Commission and Fee Structure

5.1 Commission Rates

Our commission rates are established in accordance with UAE real estate industry standards and are disclosed transparently before any formal agreement. Commission is typically payable upon successful completion of property transactions.

5.2 Payment Terms

  • Commission payments are due within 30 days of property transaction completion
  • All fees are exclusive of applicable UAE taxes (VAT)
  • Payment methods and schedules will be specified in individual service agreements

6. Property Information and Marketing

6.1 Information Accuracy

While we strive to provide accurate property information, all details are subject to verification. Property specifications, prices, and availability may change without notice based on developer updates.

6.2 Marketing Materials

All marketing materials, floor plans, and property renderings are provided for illustrative purposes and may not reflect final construction or actual property conditions.

7. Limitation of Liability

7.1 Service Limitations

Our liability is limited to the scope of real estate brokerage services. We are not responsible for:

  • Construction defects or property conditions
  • Developer delays or project modifications
  • Market fluctuations affecting property values
  • Third-party service provider performance

7.2 Maximum Liability

In no event shall our total liability exceed the amount of commission received for the specific transaction in question.

8. Confidentiality and Data Protection

8.1 Client Information

We maintain strict confidentiality regarding all client information and transactions in accordance with UAE data protection laws and real estate industry standards.

8.2 Marketing Consent

By engaging our services, clients consent to the use of transaction information for general marketing purposes, provided individual privacy is maintained.

9. Dispute Resolution

9.1 Governing Law

These Terms are governed by the laws of the United Arab Emirates and the Emirate of Dubai.

9.2 Dispute Resolution Process

Any disputes arising from these Terms or our services shall be resolved through:

  1. Direct negotiation and mediation
  2. Dubai Courts system, if mediation is unsuccessful
  3. All proceedings shall be conducted in Arabic or English as appropriate

10. Termination

10.1 Service Termination

Either party may terminate service agreements with written notice, subject to completion of ongoing transactions and settlement of outstanding obligations.

10.2 Post-Termination Obligations

Confidentiality and payment obligations survive termination of services.

11. Compliance and Regulatory Matters

11.1 Anti-Money Laundering

We maintain strict compliance with UAE anti-money laundering regulations and require proper documentation of funding sources for all transactions.

11.2 Foreign Investment Compliance

We assist clients in understanding and complying with UAE foreign ownership regulations and freehold/leasehold distinctions.

12. Amendments and Updates

These Terms may be updated periodically to reflect changes in UAE regulations or business practices. Continued engagement of our services constitutes acceptance of updated Terms.
